Mr. Mahadeb Ghosh … the petitioner Mr. Sunil Kumar Gupta …for the State Mr. Siddhartha Sarkar Mr. Sourav Gupta …for respondent no.8 By filing the present writ petition, the petitioner seeks an order for the demolition of the construction allegedly carried out by respondent no. 8 without obtaining any permission from the Panchayat Authority. The petitioner claims to be a co-sharer of the land on which the building has been erected and contends that the construction exceeds the share of respondent no. 8. Learned counsel appearing for respondent no. 8, however, has produced the sanctioned plan of the building along with the requisite conversion certificate from the competent authority. Consequently, the petitioner’s allegation that the building was constructed without a sanctioned plan is without merit. 2 It is further noted that a title suit concerning the right, title, and interest in the property is pending before the competent Civil Court. Any grievance of the petitioner in this regard shall be addressed in the said civil proceedings. It is made clear that the dismissal of this writ petition shall have no bearing on the pending civil suit, which shall be adjudicated in accordance with law. In view of the foregoing, WPA 2232 of 2026 is dismissed. Let the sanctioned plan and the conversion certificate be retained on record. A copy of these documents has also been provided to learned counsel for the petitioner. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings. (Kausik Chanda, J.)
