THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 4853 OF 2026 The Court made the following order:
The petitioner had been awarded the contract of work(s) under the subject scheme in Krishna District. After execution of the said contract, a final bill was prepared for a sum of Rs.77,18,646/- as per the sanctioned orders. Among the total amount, a balance amount of Rs.32,78,632/- yet to be paid to the writ petitioner. As the payment of the said amount has not been made by the respondents, the petitioner has approached this Court by way of this writ petition. 2. It is the contention of the petitioner that even though the respondents admitted that the petitioner is entitled for balance payment of Rs.32,78,632/-, no payment is being made. The petitioner contends that such non-payment of money is clearly arbitrary and high-handed requiring the interference of this Court. 3. This Court, in various orders, including the judgment of a learned Single Judge of this Court dated 05.10.2021 in W.P.No.10038 of 2021 and batch had taken the view that such non-payment of dues is arbitrary and that such dues need to be cleared by the respondents at the earliest. 4. On the other hand, Sri Mallikharjuna Moorthy, learned Standing Counsel for the Housing, has placed on record the written instructions received from the District Head, Housing admitting balance amount of
4
Rs.32,78,632/- payable to the petitioner. The written instructions further indicate that the District Head Housing has submitted the proposals for release of the budget to the Government vide letter dated 05.09.2026 and seek three months time to upload the bill in Nidhi Portal. 5.
In view of the aforesaid directions of this Court in various cases and after hearing the submissions of learned counsel for the petitioner and learned Standing Counsel for Corporation, this Court deems it appropriate to dispose of this Writ Petition, at the admission stage, by directing the respondents to pay admitted balance amount Rs.32,78,632/- to the petitioner within a period of four (04) months from the date of receipt of copy of this order. 6. With these observations and directions, this Writ Petition is disposed of. No order as to costs. 7. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. ________________________________ VENKATESWARLU NIMMAGADDA, J Dt: 30.09.2026 Mnr
