JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners – accused in both the petitions are before this Court calling in question orders dated 31.01.2026 and 06.01.2026, both passed by the XXVIII Additional Chief Judicial Magistrate Court, Bengaluru, in C.C.Nos.14108/2025 and 32624/2024, impugned in the respective petitions, whereby, concerned Court issues fine levy warrant on account of breach of the terms of joint compromise by the petitioners. 2. The complainant on institution of the proceedings under Section 138 of N.I.Act, the proceedings comes to be closed on a joint compromise memos being filed in both the petitions. The petitioners - accused being the signatories to the joint compromise memos, could not make any money in terms of the joint compromise memos. Therefore, the concerned Court issues fine levy warrants against the petitioners in both the proceedings. The sword of fine levy warrants, hanging on - 5 - HC-KAR NC: 2026:KHC:19617 WP No. 5647 of 2026 C/W WP No. 5648 of 2026 the head of the petitioners has driven the petitioners to this Court in the subject petition. 3. The petitioners - accused to get away the criminal proceedings, the complainant cannot be made to roam from pillar to post to get his money in terms of the joint compromise memos, which are agreed and signed by the petitioners themselves. There is no warrant of interference in the impugned warrants issued by the concerned Court. 4. Finding no merit in the petitions, the petitions stand dismissed.
