1. The petitioner is absent.
2. On 10.02.2026, following order was passed :-
“Challenge is to order dated 13.01.2026, passed by respondent, whereby the petitioner was called upon to remove the unauthorised structures mentioned therein.
2. After having heard at length, when we were not inclined to grant relief, petitioner-in-person, made a statement that he himself will demolish the unauthorised construction as noted in notice dated 24.11.1998. He submits that the work of demolition shall commence on 16.02.2026 and shall be completed by 31.03.2026.
3. Statement is accepted as an undertaking given to the Court. The petitioner shall submit the progress report of demolition along with photographs. The respondent shall monitor demolition and shall also file progress report. If the petitioner fails to commence demolition on 16.02.2026, respondent shall proceed to demolish the unauthorised structure on 17.02.2026 and shall complete the demolition, as expeditiously as possible.
4. List on 23.02.2026 for filing progress report.”
3. Thereafter, the matter was listed from time to time.
4. Mr. Kasat, learned counsel appearing for the respondent, submits that the unauthorized construction has been removed. Affidavit to that effect is already filed on record.

6. He further submits that the cost of demolition has been deposited by the petitioner in terms of the order passed by this Court on 16.04.2026. He seeks permission to withdraw the amount.
7. Permission is granted.
8. The amount shall be paid to the respondent upon making an appropriate application.
9. In that view of the matter, nothing survives in the petition. The petition is accordingly dismissed. (JUDGE) (JUDGE) Kartikeya
