Heard learned counsel for the applicant as well as learned A.G.A. for the State. This application under Section 529 BNSS has been filed to direct the court concerned to decide the Case No. 20/2025, under Section-12(1) of the Protection of Women from Domestic Violence Act, 2005 pending before learned Additional Civil Judge/ FTC- I Mau. Learned counsel for the applicant submits that the said case is pending before the court concerned since 2025 and as per Section 12 (5) of the aforesaid Act, Magistrate shall endeavour to dispose of every application made under sub-section (1) within a period of 60 days from the date of its first hearing but more than six months have been passed, the said case has not been decided as yet, therefore, the same may be expedited within a stipulated time as fixed by this Court. Considering the facts and circumstances of the present case, the court concerned is directed to make all endeavours to decide the aforesaid case as per Section 12 (5) of Protection of Women from Domestic Violence Act, after giving opportunity of hearing to both the parties, without giving any unnecessary adjournments to either parties, if there is no other legal Versus Counsel for Applicant(s) : Ashutosh Kumar Pandey Counsel for Opposite Party(s) : G.A.
