JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused is before this Court in this revision petition filed under Section 397 read with Section 401 of Cr.PC with a prayer to set aside the judgment and order of conviction and sentence passed in C.C.No.479/2008 dated 03.09.2019 by the Court of III Additional Civil Judge and JMFC, Maddur, and the judgment and order passed in Crl.A.No.138/2019, dated 02.01.2021 passed by the Court of IV Additional District and Sessions Judge, Mandya. 2. Petitioner herein was prosecuted for offence punishable under Section 138 of the Negotiable Instruments Act, 1881 in C.C.No.479/2008 before the Court of III Additional Civil Judge and JMFC, Maddur and vide judgment and order dated 03.09.2019 he was convicted and sentenced for offence punishable under - 3 - HC-KAR NC: 2026:KHC:9958 CRL.RP No. 18 of 2022 Section 138 of the N.I.Act and the said judgment and order of conviction and sentence passed in C.C.No.479/2008 was modified in Crl.A.No.138/2019 by the Court of IV Additional District and Sessions Judge, Mandya by judgment and order dated 02.01.2021. 3. Learned counsel for the respondent fairly submits that dispute between the parties has been amicably settled and he has got instructions from his party to submit that the order impugned may be set aside and the petitioner may be acquitted of the offence for which he has been convicted and sentenced by the Courts below. 4. The said submission is placed on record. Accordingly, the following: ORDER i. The Criminal revision petition is allowed. ii. The impugned judgment and order of conviction and sentence passed against the - 4 - HC-KAR NC: 2026:KHC:9958 CRL.RP No. 18 of 2022 petitioner by the courts below are set aside and he is acquitted of the offence punishable under Section 138 of the N.I.Act.
