HIGH COURT OF JUDICATURE AT ALLAHABAD PUBLIC INTEREST LITIGATION (PIL) No. - 2380 of 2026 Chief Justice's Court HON'BLE ARUN BHANSALI, CHIEF JUSTICE HON'BLE KSHITIJ SHAILENDRA, J. 1. This petition, purportedly in public interest, has been filed by the petitioner seeking an impartial inquiry regarding construction of public toilet on a private land in Village Narsihdar, Tehsil Barhaj, District Deoria. 2. Submissions have been made that the Gram Pradhan got constructed the public toilet on his personal land and the toilet is not permitted to be used by general public, even access to the said toilet is not open. 3. A perusal of the record indicates that the construction had taken place in the year 2023 and the complaints made by the petitioner have been repeatedly responded, indicating that the toilet is available for use by general public. 4. When counsel for the petitioner was put a query regarding the grievance of the petitioner, the submission made was that the toilet in question needs to be removed and a fresh toilet on a public land needs to be constructed. 5. The plea and prayer sought to be raised, apparently have no substance. The pictures, which have been produced with the petition, clearly show that the toilet does have an access for the public, inasmuch as certain villagers are standing outside the toilet. 6. In view thereof, the plea sought to be raised, apparently is based on Versus Counsel for Petitioner(s) : Sarvesh Chaubey, Gajendra Singh Yadav Counsel for Respondent(s) : Nagendra Pandey (S.C.) Anurag Yadav .....Petitioner(s) State of U.P. and 4 others .....Respondent(s) some personal issues between the petitioner and the Gram Pradhan. 7. There is no substance in the petition, the same is therefore, dismissed.
