Heard learned counsel for the parties and perused the records. 2. By means of this petition filed under Article 226 of the Constitution, petitioners have questioned the first information report dated 07.11.2025 in Case Crime No. 633 of 2025, under Sections- 69, 89 and 351(3) B.N.S., 2023, Police Station- Gagha, District- Gorakhpur. 3. Office report dated 27.04.2026 & 16.07.2026 records as under: "It is most humbly submitted that as per report submitted by the Legal Cell, O/o Director General of Police, Uttar Pradesh, chargesheet has been filed. Therefore, in view of above, the case is put up for order before Hon'ble Court." 4. In view of the fact that charge sheet in the case has already been submitted by the police after collecting evidence at its level finding petitioners' involvement in the offence complained of, in our considered view it would be appropriate that the charge sheet so filed is questioned in an appropriate proceeding at appropriate forum. 5. Accordingly, we decline to grant any further indulgence in the matter. 6. However, we may clarify that in the event charge sheet is not submitted in the court initially granted temporary protection from arrest in this petition would continue to operate till the submission of charge sheet by the police in the court of competent jurisdiction.
