NO.921/2024: Heard the learned Senior Counsel appearing for the appellants in the writ appeal. - 4 - HC-KAR NC: 2026:KHC:8615-DB WA No. 921 of 2024 C/W CCC No. 1011 of 2024 2. It is submitted by the learned Senior Counsel that direction is issued by the learned Single Judge to consider the claim raised by the respondent herein for regularization of service. It is submitted that the claim of the respondent has been considered and an endorsement has been issued on 01.09.2025. 3. In the above view of the matter, we are of the opinion that nothing survives for consideration in the writ appeal and it is accordingly closed. CCC. NO.1011/2024: 4. The learned Senior Counsel appearing for the accused has placed a detailed Affidavit on record. It is contended that Annexure-B, which is produced along with the writ appeal differs from the actual details of the respondent herein. It is submitted that an endorsement has been issued on 01.09.2025, rejecting the claims of the complainant. - 5 - HC-KAR NC: 2026:KHC:8615-DB WA No. 921 of 2024 C/W CCC No. 1011 of 2024 5. Having considered the contentions advanced, we notice that the direction issued was as follows: “iii. The respondents shall reconsider the representation submitted by the petitioner afresh by taking cognizance of the provisional list as per Annexure-M more particularly Sl.No.134 to 356; iv. This exercise shall be completed within a period of three months from the date of receipt of certified copy of this order.” 6. We also notice that an endorsement has been issued on 01.09.2025 rejecting the representation. Though, the learned senior counsel would contend that the endorsement is not issued considering the aspects as directed by the learned Single Judge, we are of the opinion that such contentions have to be considered in a challenge to the endorsement. Since the endorsement has been issued on 01.09.2025, we are of the opinion that there is no justification in proceeding with the Contempt of Court Cases. - 6 - HC-KAR NC: 2026:KHC:8615-DB WA No. 921 of 2024 C/W CCC No. 1011 of 2024 7. The contempt of court case is accordingly closed recording the endorsement dated 01.09.2025.
