1. This hearing has been done through hybrid mode. 2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing of the FIR No. 499/2020, registered at Police Station Keshav Puram, Delhi, for the commission of offences punishable under Sections 376/506/509/34 of the Indian Penal Code, 1860 (hereafter referred to as the ‘IPC') and Section (1) (r) (s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as ‘SC/ST Act’) and all consequent proceedings emanating therefrom on the basis of settlement arrived at between the parties. 3. Issue notice. The learned APP accepts notice on behalf of the State. 4. All the petitioners and respondent no. 2 are present before this Court and have been identified by their counsel and the concerned Investigating Officer (IO). 5. known each other for several years, sharing cordial and friendly relations. Owing to a misunderstanding between them, the present FIR came to be registered. 6. Learned APP for the State opposes the prayer for quashing of the FIR and submits that the allegations levelled in the FIR are serious in nature. 7. On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that she has entered into compromise out of her own free will and without any pressure, coercion or threat. She further states that she has no objection if the present FIR is quashed. 8.
In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9. Accordingly, FIR No. 499/2020, registered at Police Station Keshav Puram, Delhi, for the commission of offences punishable under Sections 376/506/509/34 of the IPC and Section (1) (r) (s) of the SC/ST Act and all consequential proceedings emanating therefrom are quashed. 10.
