The present Petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 [“Arbitration Act”], by the Petitioner seeking appointment of an Arbitrator to adjudicate upon the disputes which have arisen between the parties under the Contract dated 03.08.2023 entered into between the parties for providing for providing Paper-based printing services and related services for the “Van Mahotsav 2023”. 2. Material on record indicates that Respondent floated a tenders for providing Paper-based printing services and related services for the “Van Mahotsav 2023” and the Petitioner herein were awarded the said Contract. Disputes have arisen between the parties regarding payment of money. It is stated that Clause 16 of the Contracts contains an Arbitration Clause which provides that disputes arising between the parties under the Agreement shall be decided by means of Arbitration and the seat of Arbitration shall be Delhi. It is stated that a Notice dated 28.10.2025 under Section 21 of the Arbitration Act has been issued by the Petitioner invoking arbitration. However, the Respondent has failed to appoint the arbitrator. The Petitioner has, therefore, approached this Court by filing the present Petition. 4. In view of the fact that disputes have arisen between the parties and there is an arbitration clause in the Contracts, this Court is inclined to appoint an Arbitrator to adjudicate upon the disputes between the parties. 5. Accordingly, Ms. Akansha Kaul, Adv. (Mob:9818131566), is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties. 6. The arbitration would take place under the aegis of the Delhi International Arbitration Centre (DIAC) and would abide by its rules and regulations. The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC. 7. The learned Arbitrator is also requested to file the requisite disclosure under Section 12(2) of the Arbitration Act within two weeks of entering on reference. 8. All rights and contentions of the parties in relation to the claims/counter-claims are kept open, to be decided by the learned Arbitrator on their merits, in accordance with law. 9. Needless to say, nothing in this Order shall be construed as an expression of this Court on the merits of the contentions of the parties. 10.
