. 2026 Heard Mr. S Afridi, learned counsel for the petitioners and Mr. R.J. Baruah, learned Addl. Public Prosecutor, Assam for the State respondent. 2. This bail application has been filed by the petitioners namely, Fakhruddin Ahmed, Rittik Hazarika and Syed Rich Ahmed @ Faruk Ahmed under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, praying for grant of pre-arrest bail in connection with Satgaon P.S. Case No. 50/2026 (corresponding to G.R. No. 1459/2026) registered under Section 305 (a) / 3 (5) of BNS, 2023. 3. An earlier bail application on behalf of the present petitioners was rejected on 20.05.2026 in AB No. 968/2026. 4. The allegation pertained to theft of a large number of Gas Cylinders from the godown of the informant by the petitioners who were employees of the said godown. 5. It is recorded in the aforesaid order dated 20.05.2026 that these accused petitioners are involved in the alleged offence and all of them were staying in the godown of the said Gas Agency as caretakers. Every day they used to sell
Page No.# 3/3 2/3 cylinders and while committing the theft of the cylinder, they used to switch off the CCTV. When the accountant made an audit, then only it came to knowledge that there is a shortage of 19 cylinders and 47 numbers of empty cylinders are missing from the dogown.
When the matter was enquired about, all the three petitioners fled away from the godown by taking Rs.55,000/-. 6. The Additional P.P submits that the aforesaid facts are revealed by the CD itself and there are several eye witnesses who have corroborated the prosecution case. 8. Having regard to the above, the prayer for pre-arrest bail stands rejected. 9. In terms of the above, this anticipatory bail application stands dismissed. 10. Send back the CD.
