This bail application has been filed on behalf of Bhade Kandulna @ Badhru Kandulna who is in custody since 28.06.2024 in connection with Mahabuang P.S. Case No. 3 of 2024 for the offences registered under Sections 376 and 34 of the IPC and under Section 4 and 8 of POCSO Act pending in the Court of learned Special Judge (POCSO), Simdega is pressed into motion. It is submitted by learned counsel for the petitioner that the allegation of penetrative sexual assault is not directed against the petitioner, but against the co-accused. Learned counsel for the State has opposed the prayer for bail and submitted that the offence of gang rape is made out against a person who is complicit in forcibly taking the victim and felicitating the offence. The petitioner is named in the FIR. Considering the gravity of offence and direct allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected.
