The petitioner has filed this writ petition seeking following reliefs:- 2 “10.1 That, this Hon'ble Court may kindly be pleased to set-aside the impugned order dated 09.09.2025 and 30.06.2025 (Annexure P/1 Colly). 10.2 That, any other relief which this Hon’ble Court deems fit and proper may also be granted in favour of the petitioner safeguarding her interest.” 2. Learned counsel for the petitioner submits that the petitioner is working on the post of Male Supervisor and is posted at Government Primary Health Centre, Sukuldehan, District – Rajnandgaon to Government Primary Health Centre, Jhalmala, District – Kabirdham. It is the contention of counsel for petitioner that the petitioner is having an old aged mother of 75 years and petitioner is also suffering with backbone ailment. Petitioner has submitted representation before the Committee constituted under the Transfer Policy, 2025, however, appropriate consideration on the representation was not given and his representation was rejected along with other 46 applications. He contended that under Clause 1.10 of the Transfer Policy, 2025, there is a provision that if an employee is under the need of appropriate treatment for serious ailment, the said employee can submit an application for his or her transfer at an appropriate place where appropriate medical facilities are available. 3. On the other hand, learned counsel for the Respondents/State would submit that the petitioner has not submitted any document to show that he or any of his family member is suffering from serious medical ailment and therefore, the ground raised by the petitioner referring to Clause 1.10 of the Transfer Policy, 2025 will not be available to the facts of the case. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. When question is posed to the learned counsel for petitioner about the period of posting of the petitioner at Government Primary Health Centre, Sukuldehan, District – Rajnandgaon, he fairly submits that the petitioner has completed more than 04 years of his service at the present place of 3 posting, Transfer is an exigency of service and any employee cannot claim as a right to be posted at a particular place of posting. Petitioner has not placed any document to prove that he or any of his family member including his mother is suffering from serious disease and therefore, in the above facts of the case, I do not find any good ground to interfere with the order of transfer of the petitioner dated 09.09.2025 (Annexure P/1).
