R MAJUMDAR, Advocate for the Respondent : GA, ASSAM, Page No.# 2/3 BEFORE HON’BLE MR. JUSTICE NELSON SAILO O R D E R 19.08.2026 Heard Mr. R. Majumdar, learned counsel for the petitioner and Mrs. S. Barua, learned State Counsel appearing for all the respondents. Having regard to the grievance projected by the petitioner, the writ petition is taken up for disposal at this stage. 2. The petitioner was dismissed from service after a departmental enquiry was conducted vide order dated 17.03.2026 (Annexure-7). According to the petitioner, the charges were not proved by the Enquiry Officer and therefore, the dismissal order is not sustainable. Aggrieved with the same, the petitioner filed an appeal under Rule 15 of the Assam Services (Discipline and Appeal) Rules, 1964 before the appellate authority on 24.03.2026 (Annexure-8). However, the said appeal has not been considered and disposed of till date and therefore, the petitioner being aggrieved is before this Court. Learned counsel for the petitioner submits that the prayer of the petitioner at this stage is for an early consideration of the appeal filed by him before the appellate authority. 3. Considering the limited grievance, the writ petition is disposed of by directing the appellate authority (respondent No.3) to consider and dispose of the appeal filed by the petitioner on 24.03.2026 by way of a reasoned and speaking order expeditiously preferably within the outer limit of 08 (eight) weeks from the date of receipt of a certified copy of this order.
