Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking following reliefs :- “1. That, this Hon’ble Court may kindly be pleased to issue a writ/ writs, order/orders quashing the impugned Investigation proceeding conducted by five members (Annexure P/9) and Impugned letter dated 30.01.2025 (Annexure P/10) in the interest of justice. 2. That, this Hon’ble Court may kindly be pleased to issue an appropriate writ, order or direction, including a writ in the nature of mandamus, directing the respondents to duly acknowledge, consider and grant the legitimate dues / benefits claims of the petitioner arising out of the work executed by him, as evidenced from the records / bills and certificates issued. 3. That, this Hon’ble Court may kindly be pleased to grant any other relief(s), which is deemed fit and proper in the aforesaid facts and circumstances of the case.” 2. The Coordinate Bench of this Court vide order dated 02.01.2025 passed in WPC No. 6358/2024 has directed the respondent No. 4/ District Education Officer, Jashpur, District Jashpur therein to release the undisputed amount to the petitioner after due verification, within a period of 30 days from the date of passing of the said order. That order was upheld by learned Division Bench of this Court vide order dated 08.05.2025 passed in Writ Appeal No. 302 of 2025 (State of Chhattisgarh & others vs. Purushotam Banerjee & another). 3. Learned counsel appearing for the petitioner contended that in compliance of order dated 02.01.2025 passed by learned Coordinate Bench / Single Bench of this Court, an enquiry was conducted in respect of said 11 work done by the petitioner and report of the said enquiry was submitted by team of five members of government officials to the Collector vide Annexure P-9, but the said enquiry was conducted 3 without issuing notice to the petitioner i.e. in his absence. Therefore, he prays that enquiry report (Annexure P-9) may be quashed / set aside and respondents No. 3 & 4 may be directed to conduct fresh enquiry after issuing notice to the petitioner, so that substantive enquiry will be conducted in presence of petitioner. 4. In reply, learned counsel for the State fairly submits that enquiry report was submitted vide Annexure P-9 by 5 member team of government officials. However, he conceded the fact that it was held without issuing notice to the petitioner and in his absence. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Since the enquiry was conducted without serving notice to the petitioner and in his absence, therefore, it cannot be said that order passed by learned Single Bench has been complied with in its true perspective. Hence, enquriy report (Annexure P-9) submitted before Collector, Janjgir-Champa is liable to be and is hereby set-aside / quashed. Respondents No. 3 & 4 are directed to conduct fresh enquiry after verifying the fact that said 11 works were done by the petitioner or not by affording due opportunity of hearing to the petitioner i.e. in his presence and , thereafter, to comply with the order dated 02.01.2025 passed by Coordinate Bench of this Court in WPC No. 6358 of 2024, which has also been affirmed by the Division Bench of this Court vide order dated 08.05.2025 passed in Writ Appeal No. 302 of 2025 (State of Chhattisgarh & others vs. Purushotam Banerjee & another). 7. With the aforesaid observations & directions, the writ petition stands disposed of. No cost (s). 8. Presence of the District Education Officer, Jashpur, District Jashpur before this Court is dispensed with. 8. Pending interlocutory application (s), if any, stands disposed of.
