Petitioner has filed this writ petition seeking following reliefs. “10.i That, the Hon’ble Court may issue appropriate writ directing the respondent authorities to revoke the order of dismissal and consequently pass appropriate order for release and grant salary, pay and allowances to the petitioner w.e.f. 11.02.2016 (from the date of suspension). 10.ii That, the Hon’ble Court may issue appropriate writ directing the respondent PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA Date: 2026.01.03 16:23:38 +0530 2 / 3 authorities to release and grant gratuity, complete/ full pension with all consequential benefits and dues with 12% interest. 10.iii Pass any other order(s) as this Hon’ble Court may deem fit and proper in the interest of justice.” 2. Learned counsel for petitioner submits that petitioner was dismissed from service on account of his conviction in Special Sessions Case No. 01/2016 for offence under Sections 13(1)(e) readwith Section 13(2) of the Prevention of Corruption Act, 1988. The order of conviction was put to challenge in Criminal appeal bearing CRA No. 1277/2017 which was allowed and the order of conviction was set aside. Petitioner thereafter had submitted a representation before the authorities for providing him monetary benefits for the period of suspension and reinstatement vide representation dated 16.01.2023. However, when no decision was taken, writ petition was filed. He also submits that the Development Commissioner, Raipur had issued a letter to the Additional Secretary, Panchayat and Rural Development Department, State of Chhattisgarh mentioning therein that the decision is to be taken at the end of the State Government for reinstatement and for granting monetary benefits and retiral dues as petitioner has attained age of superannuation on 01.02.2022. 3. Learned State counsel submits that when she was served with a letter dated 02.01.2026 by the petitioner in the court, she sought instruction and according to her instruction, decision will be taken on the letter dated 02.01.2026 within a period of three months. 4. At this stage, learned counsel for petitioner submits that as the petitioner attained age of superannuation in the year 2022 and is facing financial difficulties, therefore, respondents be directed to consider claim of petitioner and to take decision on the letter dated 02.01.2026 within an outer limit of 02 months. 3 / 3 5. On due consideration of the submission made by learned counsel for the respective parties, particularly considering the submission of the State counsel based on letter dated 02.01.2026, this writ petition at this stage is disposed of directing respondents to take decision on letter dated 02.01.2026 in accordance with law, expeditiously within a further period of 02 months from the date of receipt of copy of this order. 6.
