By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioners seek quashing of the FIR No.584/2022 dated 02.08.2022 registered at PS.: Okhla Industrial Area, Delhi under Sections 376/376(D)/354/506/509/498A/323/34 of the Indian Penal Code, 1860 (IPC) and all proceedings emanating therefrom, in view of Settlement Agreement dated 16.02.2026 (Annexure P-3), whereby the petitioners and the respondent no.2 have mutually resolved their disputes.
2. Issue notice. Learned APP accepts notice and submits that he has no objection if the present FIR is quashed.

submits that the respondent no.2 has no objection if the present petition is allowed. 4. This Court has further had the occasion of interacting with the petitioners as well as the respondent no.2, who all are present in Court. They affirm the terms of the aforesaid Settlement Agreement dated 16.02.2026 wherein the parties have agreed to put a quietus to their disputes. They submit that the marriage inter se the respondent no.2 and petitioner no.1 has since been dissolved by mutual consent under Section 13B(2) of the Hindu Marriage Act, 1955 vide Deed of pronouncement of Divorce dated 04.04.2026, and as such, the parties have agreed to put a quietus to their disputes. Respondent no.2 hence submits that she does not wish to continue the aforesaid FIR against the petitioner. 5. The petitioners and the respondent no.2, present in Court, as well as their credentials as on record, have been identified by the Investigating Officer. 6. Upon an overall consideration of the existing facts and circumstances, even though this Court is mindful that the present FIR has been registered under Sections 376/376(D)/354 of the IPC, however, this Court is inclined to quash the present FIR in exercise of its inherent powers under Section 528 of BNSS. As such, the quashing of the present FIR shall be in the interest of the petitioners and respondent no.2. Moreover, they have also voluntarily arrived at a settlement, and the present petition is also supported by their respective affidavit(s) to the said effect. They shall remain bound by all the terms and conditions of the settlement arrived inter se themselves. Accordingly, as also following the law laid down by the Hon’ble Supreme Court in Jitendra Raghuvanshi & This is a digitally signed order. Therefore, the present petition is allowed and FIR No.584/2022 dated 02.08.2022 registered at PS.: Okhla Industrial Area, Delhi under Sections 376/376(D)/354/506/509/498A/323/34 of IPC as also all proceedings emanating therefrom are hereby quashed. 8.
