This bail application has been filed by the petitioner namely, Asruddin Miya, under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, for granting regular bail in connection with Basistha P.S. Case No. 262/2026 under Section 61 (2)/ 305 (e)/ 317 (2) BNS, 2023 read with Section 7 of the E.C. Act.

The allegation is that one truck bearing registration No. AS-01-KC-0972 along with 200 bags of suspected PDS rice, believe to be Government property was intercepted on 14.07.2026, in course of naka checking at Lalmati, Guwahati. The petitioner was the driver of the said truck and allegedly he could not produce any documents in respect of the said consignment.

The learned counsel for the petitioner has taken us through the documents annexed to the instant application more particularly the e-way bill which is part of Annexure-V to the instant bail application wherefrom it appears that the owner of the PDS rice was the bona fide purchaser of the PDS rice and the vehicle number is also mentioned in the said e-way bill as AS-01-KC-0972 which corresponds to the registration number of the seized truck mentioned in the FIR.
5. The petitioner has already spent 23 days in custody.
6. Having regard to the above, the prayer for bail is allowed. The petitioner shall be released on bail on furnishing a bail bond Rs. 20,000/- (rupees twenty thousand) with one surety of the like amount to the satisfaction of the learned Jurisdictional Magistrate.
7. It is further provided that the petitioner shall cooperate with the trial and he shall not try to intimidate or influence any witnesses acquainted with the
facts of this case, in any manner.
