The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondents to comply with directions of the Hon’ble Supreme Court in Nipun Saxena vs Union of India, 2019(2) SCC 703 against uploading of rape FIRs. They are also seeking direction to respondents to take action against erring officials who revealed name of the rape victim.

The petitioners are residents of Ludhiana. Petitioner No.1 is a public-spirited person. He is involved in long standing civil & criminal litigation with land grabbing mafia and Nihangs. He has lodged multiple FIRs against them. Due to his activities, his wife (petitioner No.2) was kidnapped on 26.07.2025 by nihangs/land mafia. She became a victim of gang rape and was forced by the police authorities and land grab mafia to implicate petitioner No.1 for the offence of martial rape. Petitioner No.1 was implicated in FIR No.192/2025 dated 27.07.2025 under section 64(1), 74, 76, 69, 351 BNS at PS Division No.8, Ludhiana. released on regular bail on the same day. They jointly approached this Court by way of CRM-M-60967-2025 seeking quashing of aforesaid FIR which is pending adjudication. The erring official, contrary to the guidelines laid down by Supreme Court in Nipun Saxena (supra), uploaded the FIR on the Punjab Police website thereby disclosing identity of the victim (petitioner No.2). He sent legal representation dated 14.03.2026 to Chief Secretary, Punjab, Secretary Home, Punjab and DGP, Punjab to lodge FIR against erring officials for uploading FIR and acting against the guidelines.

The petitioner No.1, who is present in person, submits that respondent has uploaded aforesaid FIR on its website in violation of
judgment of Hon’ble Supreme Court in Nipun Saxena (supra). He has made representations to authorities but to no avail.

Learned State counsel, on instructions from Inspector Amritpal Sharma, submits that aforesaid FIR stands removed from website. The petitioner is a chronic litigant. He has filed 28 petitions before this Court. There are eight cases registered against him and he has also lodged multiple cases against others.

Considering the fact that respondent has already removed FIR from its official website, the petition stands disposed of. The authorities are directed to be careful in future.
