$~45 * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) 9036/2026 & C.M. APPL. 42330/2026S LALIT KUMAR .....Petitioner Through: Mr. Prince Jain, Adv. versus GOVT OF NCT OF DELHI & ANR. .....Respondent Through: Mr Dhruv Rohatgi Panel Counsel GNCTD Ms Chandrika Sachdeva Mr Dhruv Kumar, Advs CORAM: HON'BLE MR. JUSTICE JASMEET SINGH O R D E R % 09.07.2026 1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers: “a) issue an appropriate writ, order or direction to the respondents No.1 & 2 for transfer of the selected admission of the minor daughter of the petitioner at a school situated at about 40 kilometer from the place of residence of the petitioner and transfer the said admission of his minor daughter to the nearby school during the range of 3 kilometer from the place of residence of the petitioner in compliance with the policy and instructions of the respondents in this context ....” 2. The facts are that the petitioner applied to the respondent No.2 for admission of his minor daughter in Class-I School under the EWS/DG/CWSN of Freeship Category. 3. In the form, the petitioner gave 27 options. The option at serial No. 9, namely, Pitambar Public School situated at Kishangarh, Near Vasant This is a digitally signed order. The petitioner subsequently realised that the school is about 33 kms from the residence of the petitioner. 5. I am of the view that the petitioner is seeking admission for his daughter who is to study in Class I and 33 kms distance would take more than an hour in travelling time only. For a child that young, the same is neither practical nor desirable. 6. The Right of Children to Free and Compulsory Education Act, 2009 (“RTE Act”) is aimed at providing meaningful education to EWS/DG/CWSN of Freeship Category people. Allotment of a school about 33 kms does not achieve the objective of the RTE Act. Wasting so much time in travelling would leave no time for the child to pursue any recreational activities which are important for a holistic development. 7. Therefore, the respondent Nos. 1 and 2 shall accommodate the daughter of the petitioner in a school near to the residence of the petitioner and preferably within a radius of 5 kms. 8. Upon the said accommodation of the petitioner’s daughter in any nearby school, the admission of the daughter of the petitioner in Pitambar Public School situated at Kishangarh, Near Vasant Kunj, New Delhi-110070 shall automatically get cancelled and the respondent shall be free to allot the same to any other deserving child. 9. The petition is disposed of in the aforesaid terms. JASMEET SINGH, J JULY 9, 2026/ (MS) This is a digitally signed order.
