The petitioner is apprehending his arrest in connection with Burmu P.S. Case No. 35 of 2022, registered under sections 414 and 34 of I.P.C and section 30(ii) of Coal Mines Act, pending in the Court of learned Judicial Magistrate, Ist Class, Ranchi. 3. Learned counsel for the petitioner submits that petitioner is owner of Piaggo Auto and allegations are made of carrying 5 tonnes coal illegally. He next submits that the said coal was being carried for personal use. He submits that petitioner has got no criminal antecedent which is disclosed in para 17 of the petition and co-accused has been granted anticipatory bail in A.B.A. No. 9996 of 2023. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that illegally the coal was being carried on the said vehicle. 5. Considering that petitioner is owner of Piaggo Auto and he has got no criminal antecedent which is disclosed in para 17 of the petition and it has been pointed out that the said coal was being carried for personal use and the co-accused has been granted anticipatory bail in A.B.A. No. 9996 of 2023, I am inclined to grant anticipatory bail to the petitioner. Accordingly, ( 2026:JHHC:14628 ) the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ist Class, Ranchi, in connection with Burmu P.S.
