In the present matter, challenge is raised to the communication dated 02/08/2024 issued by the Education Officer (Secondary), Zilla Parishad, Wardha, directing the President/Secretary, Saraswati Mata Vidyaprasarak Mandal, Thanegaon, Tal. Karanja, District Wardha not to take policy decision by any group of the trustees considering that there is a faction in the said Trust. 2. On a specific query put to the Education Officer through the learned Assistant Government Pleader to show the source of power of the Education Officer to issue such prohibitory order against the President/Secretary of any Trust, on instructions, learned Assistant Government Pleader clarified that it was a suggestion and it was never the intention of the Education Officer to issue any prohibitory order against the President/Secretary of the said Trust. 3. In short, it is the submission of the learned Assistant Government Pleader that there is no such power with the Education Officer to issue such direction prohibiting the 2/2 21-WP-6208-24.odt President/Secretary of any Trust to take any policy decision. 4. In that view of the matter, we allow the writ petition and thereby quash and set aside the impugned communication dated 02/08/2024 to the extent prohibiting the President/Secretary of the aforementioned Trust to take policy decision. 5.
