JUSTICE ANIL KUMAR CHOUDHARY --------- For the Petitioner: :Mr. Navneet Sahay, Advocate For the State :Mr. Rajneesh Vardhan, Addl.P.P. For the Informant :Mr. P.P.N. Roy, Sr. Advocate; Mr. Pandey A.N. Roy, Advocate --------- 04 /Dated: 14.05.2026 Heard the parties. The petitioner has moved this Court for grant of bail in connection with Sakchi P.S. Case No.187 of 2025 registered for the offences punishable under sections 316(2), 318(2), 319(2), 336(3), 338, 340(2), 351(2), 352 and 61(1) of the BNS, 2023. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has taken Rs. 1.25 crores in cash from the informant for developing a property and handing over the same to the informant but he has not given the property concerned to the informant. It is next submitted that the claim of the informant is based upon some agreement in which as per the informant, bears the signature of the petitioner but drawing attention to page no. 17 of the second supplementary affidavit (Annexure-2) it is submitted that the father of the petitioner has lodged Adityapur P.S. Case No. 105 of 2026 mentioning therein that the said agreement has been forged by the informant. It is further submitted that the allegations against the petitioner are all false. It is next submitted that the dispute between the parties is purely a civil dispute in nature and a cloak of criminal case has been given to a civil dispute only to harass the petitioner and for wreaking vengeance. It is then submitted that the petitioner has been in custody since 18.3.2026, as has been mentioned in paragraph no. 18 of the bail application. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. and the learned senior counsel for the informant vehemently opposed the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above named petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamshedpur, in connection with Sakchi P.S. Case No. 187 of 2025 with the condition that the petitioner will cooperate with the trial of the case and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case.
