IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.1203 of 2026 Prasanta@Sachidananda Khamari & another …. Petitioners Mr. A.K. Saa, Advocate -Versus- State of Odisha …. Opposite Party Mr. M.K. Mohanty, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 05.03.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Puintala P.S. Case No.331 of 2025 corresponding to G.R. Case No.2126 of 2025 pending in the court of learned S.D.J.M., Balangir on the grounds stated. 3. Perused the F.I.R. as at Annexure-1. The petitioners had earlier approached this Court in ABLAPL No.15013 of 2025 disposed of on 5th January, 2026, a copy of which is at Flag- A1, thereby, directing them to be released on bail subject to verification of criminal antecedent. Since the petitioners are having two criminal cases each, hence, could not have moved the learned court below pursuant to the order in the ABLAPL and for that I.A. No.115 of 2026 was filed seeking modification and it is disposed of on 22nd January, 2026 giving liberty for them to renew the prayer with a fresh application filed. Recorded the objection to the State. It is claimed that the petitioners have been implicated on the basis of disclosure made by the co-accused driver. Considering the above facts and the allegation to the effect that the petitioners received goods from the driver of the truck, who had earlier allowed to go on bail but having criminal cases to their credit, this Court is inclined to direct them to surrender before the learned SDJM, Balangir for being released only upon absence of more than two criminal antecedents against each them with an inquiry held in that regard. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL petition stands disposed of with a direction to the petitioners to surrender before learned S.D.J.M., Balangir within a fortnight from today and in the event, they surrender in compliance thereof, shall be released on bail in connection with G.R. Case No.2126 of 2025 on furnishing bail bonds of Rs.30,000/- (rupees thirty thousand) each with one solvent surety for the like amount each to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case after holding the enquiry as regards the antecedent. 6. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge Balaram Designation: PERSONAL ASSISTANT
