HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 39625 of 2026 Court No. - 5 HON'BLE PRAKASH PADIA, J. HON'BLE VIVEK SARAN, J. 1. The attachment order dated NIL issued by the Collector/Assistant Collector, Aliganj, District Etah is under challenge in the present petition. 2. It is clear from the perusal of the record that the aforesaid attachment order was passed pursuant to the award passed by the Motor Accident Claims Tribunal in Motor Accident Claim Petition No.258 of 2014. 3. It is argued by learned counsel for the petitioner as stated in paragraph no.10 of the writ petition that against the aforesaid award, First Appeal From Order Defective No.338 of 2026 has already been preferred by the petitioner. 4. In view of the aforesaid, we are of the opinion that, since the order of attachment was passed pursuant to the award passed by the Motor Accident Claims Tribunal, against which the First Appeal From Order (Defective) filed by the petitioner is pending consideration before this Court, the petitioner is at liberty to move an appropriate application before the appropriate forum. 5. Subject to the aforesaid liberty, this petition stands dismissed. September 30, 2026 Deepika Versus Counsel for Petitioner(s) : Ram Mohan, Vaibhav Singh Counsel for Respondent(s) : C.S.C.
