investigation, be kept under lien / debit-freeze, and that the remaining balance in the Petitioner's bank account be immediately released for normal operations…”
2. For the reasons stated in the petition, issue notice. 3. Ms. Swati, learned CGSC accepts notice on behalf of respondent Nos. 1 and 2. 4. There is nobody appearing on behalf of the other respondents, however, the matter is being taken up for hearing today. 5. The brief facts of the case are that in the present case, the petitioner is engaged in the business of sale and repair of spare parts of electric vehicles (EVs) and in ordinary course of business, the complainant placed an order of EV spare parts with the petitioner and paid an amount of Rs. 800/- pursuant to that order in his bank account maintained with the respondent No. 3 Bank. 6. The petitioner dispatched the ordered goods but due to some misunderstanding, the complainant lodged a cybercrime complaint dated 11.05.2026 bearing acknowledgement No. 31105260105249. 7. Pursuant to the said complaint, the account bearing No. 10201389301 maintained with the respondent No. 3 i.e., IDFC FIRST Bank Ltd., Krishna Nagar Branch, Delhi, was freezed. 8. Hence, the present petition has been filed. 9. Mr. Nisar, learned counsel for the petitioner, draws my attention to Annexure P-5 annexed with the petition, wherein the payment received from the complainant i.e., the disputed amount is shown as Rs. 800/-. 10. It is further stated by Mr. Nisar, learned counsel, that the said amount is already returned to the complainant. This is a digitally signed order. 11.
Be that as it may, I am of the view that the freezing of the bank account of the petitioner in its entirety putting the entire banking operations to a complete halt cannot be allowed when the dispute is only with regards to a portion/part of the account balance, the undisputed effective account balance cannot be freezed. 12. To my mind, freezing of a bank account is an action entailing serious consequences creating hardships for commercial entities/individuals in their smooth functioning and the same might result in commercial death of the petitioner’s business activities. 13. For the said reasons, it is directed that the respondent No. 3 bank, shall maintain a lien only to the extent of Rs. 800/- and subject to the same, the account of the petitioner bearing No. 10201389301 maintained with IDFC FIRST Bank Ltd., Krishna Nagar Branch shall be permitted to be operative. 14. In view of the order passed, Mr. Nisar, learned counsel for the petitioner, does not press the petition and the same stands disposed of in the aforesaid terms, along with pending applications, if any.
