JUSTICE R.K. PATTANAIK Order No. ORDER 09.03.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with G.R. Case No.3239 of 2023 pending in the file of learned the Special Court POCSO, Kendrapara arising out of Marine P.S. Case No.175 of 2023 on the grounds stated. 3. Perused the FIR as at Annexure-1. Mr. Sahoo, learned counsel for the petitioner submits that the present accused has accepted the victim and a marriage has taken place between them recently and while claiming so, he refers to a receipt issued by a temple at Ichhapur, Kendrapara. Considering the FIR as at Annexure-1 and by the time of the alleged incident, the victim was a minor aged about 17 years and her marriage is said to have taken place after attaining majority, this Court, for the fact that the petitioner is a young boy aged about 24 years, p. 2 is of the view that he though not entitled to pre-arrest bail but should be directed to surrender before the learned court below for being released subject to verification of the claim regarding his marriage with the daughter of the informant on 7th January, 2026. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the learned court below or the Court session over the matter within a fortnight from today, it is directed that he shall be released on bail in connection with G.R. Case No.3239 of 2023 corresponding to Marine P.S. Case No.175 of 2023 on furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed as deemed just and proper and in the facts and circumstances of the case, however, with a prior notice to the informant and confirmation regarding the marriage of his daughter with him as is claimed at present. 6.
