ORAL ORDER This petition is filed by the accused No.2 in Crime No.138/2025 registered by the respondent for the offences punishable under Sections 109, 115(2), 352 read with Section 3(5) of the Bharatiya Nyaya Sanhitha, 2023 (for short, 'the BNS, 2023). 2. The case of the prosecution is that on 16.05.2025 at about 7 p.m., two persons abused the injured with filthy language and threatened him of dire consequences. After assaulting him, they pushed him due to which he fell down and

the accused fled from the spot. One of the persons who had gathered at the spot, on seeing the injured called the Emergency Response Support System number-112. The Police came to the spot and admitted the injured to the hospital. The petitioner filed a petition in Crl. Misc. No.4924/2025 under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, which was rejected in terms of an order dated 18.06.2025.
The petitioner is, therefore, before this Court. 3. The learned counsel for the petitioner is absent. 4. The learned High Court Government Pleader submitted that the charge sheet is now filed against the petitioner for the offences punishable under Sections 109, 115(2), 352 read with Section 3(5) of the BNS, 2023. He, therefore, submits that this petition be disposed of reserving liberty to the petitioner to work out his remedy before the jurisdictional Sessions Court. 5. In that view of the matter, the Petition is dismissed. Liberty is reserved to the petitioner to file
