Kausik (Rejected) CRM (M) 1327 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Chandipur Police Station Case No. 475 of 2024 dated 26.12.2024 under sections 103(1)/3(5) of the BNS, 2023. And In the matter of : Debasish Maity @ Bipul Maity ……Petitioner. Mr. Sabir Ahmed Mr. Quazi Ezaz Ahmed Mr. Dilwar Azad ……for the Petitioner. Mr. Avishek Sinha Ms. Madhumita Basak ……for the State. Learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated in connection with the instant case and is in custody for more than 1 year. Learned advocate for the State submits that already charges have been framed, 5 witnesses have been examined and the prosecution of vulnerable witnesses are left. A report has been submitted before this Court which reflects that the date has been fixed by the learned Trial Court continuously from 9th March, 2026 to 7th April, 2026. The same elaborates regarding the proposed witnesses to be examined. 2 Be that as it may, prosecution would take steps to implement the examination of the witnesses on the date so fixed in the report. At this stage I do not intend to enter into the merits of the case. Petitioner is at liberty to approach this Court after 30th April, 2026. With the aforesaid observations the bail application being CRM (M) 1327 of 2025 is dismissed at this stage. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
