In this writ petition, the petitioner-defendant has called in question the order dated 10.02.2026 passed by the I Addl. Civil Judge & JMFC, Hunsur on I.A.No.IV filed under Order 6 Rule 17 of CPC, in O.S.No.167/2021, whereby the said application has been allowed. 2. For the sake of convenience, the parties are referred to as per their ranking before the Trial Court in Original Suit. 3. The plaintiffs filed a suit in O.S.No.167/2021 before the Trial Court seeking the relief of permanent injunction. Subsequently, the plaintiff filed I.A.No.II under Order VI Rule 17 of CPC seeking amendment of the plaint to include - 3 - HC-KAR NC: 2026:KHC:14257 WP No. 8096 of 2026 the relief of declaration. The Trial Court, by order dated 13.10.2022, allowed the said application. Thereafter, the defendant entered appearance and filed written statement. The plaintiff filed one more application i.e., I.A.No.IV under Order VI Rule 17 of CPC seeking amendment to the boundaries of the suit schedule property. The said application came to be allowed by impugned order dated 10.02.2026. Aggrieved by the said impugned order dated 10.02.2026 passed by the Trial Court, the present petition is filed. 4. The application i.e., I.A.No.IV has been filed seeking amendment to the boundaries of the suit schedule property by inserting the word ‘road’ to the boundary on the east, by deleting the words ‘lands of defendants’. The parties have not adduced any evidence. Before the matter was posted for evidence, the application has been filed. Viewed from any angle, there is no error or illegality in the impugned order passed by the Trial Court warranting interference by this Court. 6. Accordingly, the writ petition is dismissed.
