The petitioner has moved before this Court for grant of bail in connection with S.T. Case No. 247 of 2025 arising out of Sidhgora P.S. Case No. 08 of 2025, registered for the offences punishable under sections 103(1), 238, 61(2), 3(5) of the B.N.S., 2023 along with Section 27 of the Arms Act. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance with the common intention with the co-accused person and in criminal conspiracy with them, has committed murder of Ramesh Kumar Sikul @ Guddu Kumar Sikul and caused disappearance of the evidence of murder by hiding the dead body. It is further submitted that the co-accused persons, namely, Suraj Mahto and Pintu, were apprehended in some other case and they led to recovery of the dead body of Ramesh Kumar Sikul @ Guddu Kumar Sikul and on the basis of their confessional statement, petitioner has been implicated in this case for having committed murder of Ramesh Kumar Sikul @ Guddu Kumar Sikul. It is further submitted that except the confessional statement of the co-accused person, there is no other material on record to implicate the petitioner in this case. It is then submitted that the petitioner has been in judicial custody since 20.01.2025 as mentioned in para no. 14 of this bail application. It is further submitted that charge has been framed on 17.07.2025 as mentioned in para no. 15 of this bail application but no witness has been examined as yet. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge – 1st, Jamshedpur, in connection with S.T. Case No. 247 of 2025 arising out of Sidhgora P.S. Case No. 08 of 2025, with the condition that the petitioner will cooperate with the trial of the case and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case.
