Heard Sri. Nishad S.A., learned counsel appearing for the petitioner; Sri. K.S. Naresh Santhosh, learned counsel appearing for the respondent No.1; and Sri. Mahabaleshwara G.C., learned counsel appearing for the respondent No.2. - 3 - HC-KAR NC: 2026:KHC:18425 CMP NO.408 OF 2024 3. Having taken note of the submission made by learned counsel appearing for the parties, I have carefully perused Clause 16 of the Agreement to Sell and Build dated 14th February, 2014 (Annexure-A), which provides for resolution of dispute between the parties through an Arbitration. In that view of the matter, I am of the view that, a retired District Judge be appointed as Arbitrator to resolve the dispute between the parties. 4. Therefore, Sri. Vishwanath V. Angadi, District Judge (Retired) is appointed as an Arbitrator to resolve the dispute between the parties in the Arbitration and Conciliation Centre (Domestic and International), Bengaluru. In order to avoid further delay in the matter, parties are directed to appear before the Arbitration and Conciliation Centre (Domestic and International), Bengaluru on 28th April, 2026 at 11.00 a.m. 5. All claims and contentions of the parties are kept open to be decided by the Arbitral Tribunal. 6.
