JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the proceedings in CC No.468 of 2024 pending before the Additional Civil Judge (Sr.Dn.) and JMFC Court, Chamarajanagara District, registered for offences punishable under Sections 420, 423, 465, 467, 468, 419, 201 read with Section 34 of IPC. 2. Heard Sri P Nataraju, learned counsel appearing for the petitioners, Sri B N Jagadeesha, learned Additional SPP appearing for respondent No.1, Sri C Mohan, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the compromise petition. Terms of settlement reads as follows: - 4 - HC-KAR NC: 2026:KHC:23049 CRL.P No. 6177 of 2025 "COMPROMISE PETITION The petitioners and the 2nd respondent respectfully submits to this Hon'ble court as under :- 1. It is submitted that, the respondent No.2 has filed a complaint against the petitioners No.1 and 2 in PCR No.2/2022 for the offences punishable under sections 420, 423, 467 and 468 R/w section 34 of IPC and the respondent No.1 police have registered a case in Cr.No.2/2023 for the alleged offences. After the investigation the police have filed the charge sheet against the petitioners for the offences punishable under sections 420, 423, 467, 468, 419 and 201 R/w section 34 of IPC in C.C.No.468/2024 pending on the file of the Learned Addl. Senior Civil Judge and JMFC at Chamarajanagara. 2. It is submitted that the respondent No.2 has filed petition against the petitioner No.1 under section 12 of the Domestic Violence Aca, in Crl.Misc. No.679/2022 on the file of the Learned Principal Civil Judge and JMFC at Chamarajanagara. In the said petition, the petitioner No.1 and the respondent No.2 have entered into a compromise and the respondent No.2 has agreed to withdraw PCR No.02/2022 filed against the petitioners and also agreed to compromise the case. 3. It is submitted that the petitioners and the respondent No.2 on the advise of the elders and the well-wishers have entered into a compromise and the respondent No.2 has agreed to withdraw PCR No.02/2022 now C.C.No.468/2024 filed against the petitioners. The parties have entered into compromise on their own will and volition and there is no fraud and collusion involved in the compromise. The respondent No.2 has no objection to quash the proceedings in C.C.No.468/2024 pending on the file of the Learned Addl. Senior Civil Judge and JMFC at Chamarajanagara against the petitioners. Wherefore, the petitioners and the respondent No.2 respectfully pray that this Hon'ble court maybe pleased to quash the proceedings n C.C.No.468/2024 registered by the respondent No.1 police for the - 5 - HC-KAR NC: 2026:KHC:23049 CRL.P No. 6177 of 2025 offences punishable under sections 420, 423, 465, 468, 419 and 201 R/w section 34 of IPC pending on the file of the Learned Addl. Senior Civil Judge and CJM at Chamarajanagara, in the interest of justice and equity." 4. The parties to the lis are present before the Court and are identified by their respective counsel. 5. In the light of application for compounding being filed along with the compromise petition and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER i. Criminal Petition stands disposed. ii. Proceedings pending in CC No.468 of 2024 pending before the Additional Civil Judge (Sr.Dn.) and JMFC Court, Chamarajanagara District, against the petitioners stands quashed.
