. 2026 Heard Mr. R. Amin, learned counsel appearing for the petitioner. Also heard Mr. M.P. Goswami, learned Addl. P.P for the State of Assam.
2. This is an application under Section 483 of the BNSS, 2023 praying for the grant of regular bail to the accused/ petitioner, namely, Subhankar Kar, who was
Page No.# 2/2 arrested on 12.07.2026, in connection with Barpeta Road P.S. Case No. 17/2026 registered under Sections 61 (2) (a)/127 (2)/ 310 (2)/ 312/ 329(3) of the BNS, 2023, read with Sections 25 (1) (a) of Arms Act.
3. The learned counsel for the petitioner has submitted that the petitioner has spent 39 days in custody and further custodial interrogation in regard to the aforesaid case may not be necessary and therefore the petitioner would be entitled to the privilege of bail.
4. The learned Addl. P.P has submitted that the Case Diary has been received and sufficient materials are there to implicate the petitioner in the commission of the offences.
5. The learned Addl. P.P has submitted that further detention of the petitioner is required, since an inter state gang is being traced out and release of the petitioner on bail at this stage may hamper the investigation of the case and also hamper the recovery of the looted items.
6. I have heard the learned counsel for the parties I have also considered the contents of the Case Diary. In my considered opinion, the petitioner would not be entitled to be granted bail at this stage.
