BAIL APPLN. 2615/2026 $~76 * IN THE HIGH COURT OF DELHI AT NEW DELHI + BAIL APPLN. 2615/2026, CRL.M.A. 19977/2026 & CRL.M.A. 19978/2026 NAVPRABHAT @ TINKU .....Petitioner Through: Mr. Deepanshu Goswami, Advocate. versus STATE OF NCT OF DELHI .....Respondent Through: Mr. Hitesh Vali, APP with Mr. Deepankar Kataria, Advocate with SI Vikram. CORAM: HON’BLE MR. JUSTICE PRATEEK JALAN O R D E R % 13.07.2026 1. By way of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks interim bail for a period of four weeks in connection with FIR No. 273/2017 dated 19.06.2017, registered at Police Station Timarpur, District North, Delhi, under Section 307 of the Indian Penal Code, 1860 [“IPC”] and Sections 25/54/59 of the Arms Act, 1959, on the ground that his mother is scheduled to undergo surgery for kidney stones. 2. Mr. Deepanshu Goswami, learned counsel for the applicant, submits that the surgery is scheduled for 27.07.2026. 3. The surgery was earlier scheduled for 21.05.2026, when the applicant had sought interim bail before the learned Sessions Court. The said application was dismissed vide order dated 13.05.2026. The applicant thereafter approached this Court by way of BAIL APPLN. This is a digitally signed order. The Order is downloaded from the DHC Server on 15/07/2026 at 11:34:33 BAIL APPLN. 2615/2026 2020/2026, which was permitted to be withdrawn vide order dated 29.05.2026. Although the surgery has now been rescheduled to 27.07.2026, the applicant has not approached the learned Sessions Court afresh, and has instead filed the present application before this Court on the same grounds as those urged in BAIL APPLN. 2020/2026. 4. The status report filed by the prosecution before the learned Sessions Court in the earlier round of proceedings is already on record. Mr. Hitesh Vali, learned Additional Public Prosecutor, has also handed up a copy of the status report filed by the Investigating Officer before this Court in BAIL APPLN. 2020/2026, alongwith all documents filed therein, which are taken on record. 5. The prosecution case concerns a gunshot injury sustained by one Ms. Vanshika. According to the prosecution, the applicant is the person who fired the shot that struck the victim. He was contacted by a person involved in a domestic dispute with a family member of the victim. The prosecution relies upon CCTV footage, Call Detail Records of the accused persons and the disclosure statement of a co-accused in support of its case. 6. The status report further records that Non-Bailable Warrants were issued against the applicant on 05.07.2017, and that he was subsequently declared a proclaimed person vide order dated 15.09.2017 passed by the learned Trial Court. He was ultimately taken into custody only on 15.01.2024. 7. It is also stated, in the affidavit filed in support of the present application, that the applicant has 18 other criminal involvements, including a conviction under Section 307 IPC in FIR No. 75/2004 This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 15/07/2026 at 11:34:33 BAIL APPLN. 2615/2026 registered at Police Station Kavi Nagar, besides several other cases involving offences under Sections 307 and 379 IPC, the Arms Act, 1959 and the Narcotic Drugs and Psychotropic Substances Act, 1985. Out of these cases, the applicant has been acquitted in five of them. 8. Insofar as the ground urged in the present application is concerned, the status report states that the medical documents pertaining to the surgery originally scheduled for 21.05.2026 were duly verified. Upon inquiry at the applicant’s residence, however, it was found that the applicant has a brother residing in Gurugram and two married sisters, one residing in Pandav Nagar, Delhi and the other in Meerut. 9. Although applications for interim bail on medical grounds ordinarily merit a humanitarian approach, I am not inclined to accept the applicant’s request, in the facts and circumstances of the present case. Apart from the seriousness of the allegations, the applicant evaded the process of law, and was arrested nearly seven years after being declared a proclaimed person. Further, as noted above, even according to the applicant, he has approximately 18 other criminal involvements, including a conviction in another case under Section 307 IPC. It is also undisputed that the applicant’s mother has another son and two daughters. Although it has been argued that the applicant’s brother is estranged from the family, no such statement was made by the applicant’s parents before the Investigating Officer, in the course of inquiry. In such circumstances, I am of the view that the applicant’s mother can be attended to during the surgery by her other children. 10. In view of the above, I am not inclined to grant the concession of interim bail to the applicant. This is a digitally signed order. The Order is downloaded from the DHC Server on 15/07/2026 at 11:34:33 BAIL APPLN. 2615/2026 11. The application, alongwith the pending applications, is accordingly dismissed. 12. It is clarified that this Court has not expressed any opinion on the merits of the case or on any application that may be filed by the applicant hereafter, which shall be considered by the appropriate Court on its own merits, in accordance with law.
