[2026:RJ-JP:14334] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 3255/2026 Tarun Bodiya @ Jon S/o Swapan Bodiya, Aged About 42 Years, R/o Village Mongla Pada Lane, Police Station Kotwali, Krishna Nagar, District Nadiya (West Bengal), Presently Tenant Of House No. 29, Devi Nagar, Police Station Shyam Nagar, Jaipur. (At Present Confined In Central Jail Jaipur). ----Petitioner Versus State of Rajasthan, through PP ----Respondent For Petitioner(s) : Mr. Nawab Ali Rathore For Respondent(s) : Ms. Aarti Sharma, PP HON'BLE MR. JUSTICE GANESH RAM MEENA Order 07/04/2026 1. This bail application has been filed by the accused petitioner u/S 483 BNSS in connection with FIR No. 57/2026 registered at Police Station Shyam Nagar, District Jaipur City (South) for offence u/S 8/22 of the NDPS Act and Section 111(4) of the BNS. 2. The allegation against the accused petitioner is that 4.05 gm. illegal durg MDMA was recovered from his possession during the patrolling by the police. 3. Learned counsel for the accused petitioner submits that the MDMA which has been recovered from the possession of the petitioner is less than the commercial quantity and the accused petitioner is in custody since 21.01.2026 and after completion of investigation, the police has submitted charge-sheet in the matter. [2026:RJ-JP:14334] (2 of 2) [CRLMB-3255/2026] 4. Learned Public Prosecutor vehemently opposed the bail application and submits that two other criminal cases of offences punishable under the NDPS Act are pending against the accused petitioner, which shows that the accused petitioner is misusing the liberty of bail granted to him earlier. 5. Considered the submissions made by learned counsel for the accused petitioner as well as learned Public Prosecutor and perused the challan papers. 6. 4.05 gm. illegal durg MDMA is said to have been recovered from the possession of the accused petitioner. The accused petitioner is facing two other criminal cases for offence punishable under Section 8/22, 25 and 29 of the NDPS Act. The commission of offence by the petitioner even after he has been extended the benefit of bail in two earlier criminal cases of NDPS Act shows that he has no fear of law and he is in habit of misusing the liberty of bail. 7. Taking into consideration the fact that two other criminal cases of similar nature were already pending against the accused petitioner when he has committed the third offence punishable under the NDPS Act, and the fact that the accused petitioner has misused the liberty of bail granted to him in earlier two criminal cases, this Court is not inclined to enlarge the accused petitioner on bail. 8. Hence this bail application is dismissed. (GANESH RAM MEENA),J Gaurav Srivastava /48
