JUSTICE D K SINGH) The present intra Court appeal has been filed impugning the judgment and order dated 22.03.2024 passed in W.P.No.5425/2023 connected W.P.No.22597/2022 by the learned Single Judge. 2. The learned Single Judge has disposed of the writ petitions on the basis of the consensus expressed by the two learned Senior counsels appearing for the parties before the writ Court. 3. Paragraphs 6 to 8 of the impugned judgment and order would read as under: "6. In that view of the matter, it has been broadly accepted by the learned Senior Counsels on both the sides that the Survey Settlement records and the revenue records shall be maintained as on today till the disposal of the civil suits. Needless to observe that the Civil Court shall decide the matter on their merits and not give any undue weightage to the revenue entries or the assignment of any new number of the suit schedule properties. 7. At this juncture, the learned Senior counsel for the petitioner would submit that in the interest of - 4 - HC-KAR NC: 2026:KHC:7510-DB WA No. 673 of 2024 justice and to avoid conflicting judgments, it would be desirable that the two suits are tried by one Court. 8. Accepting the submission of the learned Senior Counsel, a direction is issued to the Prl. District Judge, Bengaluru Rural District, to make over O.S.No.436/2020 which is pending before the Civil Judge and JMFC, at Devanahalli, to the Court of the Senior Civil Judge and JMFC at Devanahalli, to be tried along with O.S.No.1185/2022. Appropriate orders in that regard shall be passed by the Prl. District Jduge, Bengaluru Rural District, to ensure that the two suits are tried by the Senior Civil Judge and JMFC, Devanahalli." 4. We fail to understand that how the respondent before the writ Court would be aggrieved by such a judgment and order passed by the learned Single Judge which is impugned in the present writ appeal. We find no merit in the submissions advanced by the learned counsel for the appellant. Therefore, we dismiss this writ appeal, however, without costs.
