BHASKAR, R/O.D.NO.2-16, BAJAR STREET, PAPARAYUDIPETA, VIKRUTAMALA, CHITTOR DISTRICT - 517526 ...RESPONDENT(S): 2 Dr. YLR, J W.P.No.7147 of 2026 Dated 23.04.2026 Counsel for the Petitioner: MUDE SAI KUMAR NAIK Counsel for the Respondent(S): GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue an appropriate Writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in failing to register an FIR and investigate the offences relating to forgery and fabrication of public documents concerning the petitioners property as illegal arbitrary and unconstitutional and consequently direct the respondents to register an FIR on the complaint of the petitioner and conduct investigation in accordance with law and pass….” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader. 3. Mr. Mude Sai Kumar Naik, learned counsel for the petitioner, submits that the petitioner, aged about 70 years, submitted a representation/complaint dated 08.09.2025 to the respondent police for registration of an FIR, but no FIR has been registered and no investigation has been conducted. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that, based on the complaint of the petitioner dated 06.03.2025, a case in Crime No.120 of 2025 was registered under Sections 419, 420, 467, 468, 471, and 506 read with 34 of ‘the IPC’, and the 3 Dr. YLR, J W.P.No.7147 of 2026 Dated 23.04.2026 investigation is in progress. It appears that the petitioner has submitted another representation dated 08.09.2025, which was not registered as an FIR. It is further submitted that civil disputes are pending between the petitioner and the unofficial respondents; therefore, the respondent police could not proceed further on the petitioner’s complaint. 5. Be that as it may, the petitioner has an alternative efficacious remedy by filing a private complaint before the learned jurisdictional Magistrate under Section 190 read with Section 200 of ‘the Cr.P.C.,’/Section 210 read with Section 223 of ‘the BNSS’. 6. Considering the entire facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, requiring the petitioner to approach the learned jurisdictional Magistrate by way of filing an appropriate complaint under Section 190 read with Section 200 of ‘the Cr.P.C.,’/Section 210 read with Section 223 of ‘the BNSS’, if so advised. 7. With the above observations and directions, the Writ Petition is disposed of. There shall be no order as to costs.
