HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 39130 of 2026 Court No. - 5 HON'BLE PRAKASH PADIA, J. HON'BLE VIVEK SARAN, J. 1. Pursuant to order dated 28.09.2026, Sri Sushil Kumar Pandey, learned counsel for the respondent - Electricity Department placed before this Court a letter dated 28.09.2026 written by the Executive Engineer to the Additional Sessions Judge (VI), Mirzapur, in which it is stated that since no theft was found against the petitioner at the relevant point of time, prayer has been made to dispose of the criminal case. 2. It is argued that the next date fixed in the matter before the court below is 06.10.2026. 3. In this view of the matter, we are of the opinion that the relief, as sought for, has already been granted and no further orders are required to be passed and the writ petition has become infructuous. 4. The writ petition is dismissed, as having become infructuous. 5. It is important to note that since a letter has already been submitted by the Executive Engineer before the court below, it is expected that the Court concerned will consider the communication/application submitted by the Executive Engineer on 28.09.2026 and decide the case on the next date fixed and in case, it is not possible on the said date, the same will be decided positively within two weeks thereafter.
