1. The petitioner has filed this writ petition seeking following reliefs:-
“10.1 That, the Hon’ble Court may kindly be pleased to call entire records from the respondents. 10.2 That, this Hon’ble Court may kindly be pleased to issue a writ in the nature of mandamus quashing
2 the impugned transfer order dated 25.06.2025, the proposal dated 22.12.2025, and the relieving order dated 08.01.2026 (Annexure P/1) in so far as, they related to the petitioner. 10.3 That, this Hon’ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the respondents to allow the petitioner to continue in his current posting at the District Office, Social Welfare Department, Mungeli, District – Mungeli (C.G.) until completion of the minimum tenure as per the Transfer Policy, 2025. 10.4 That, the Hon’ble Court may kindly be pleased to grant any other relief, as it may deem fit and appropriate.”

Learned counsel for the petitioner submits that the petitioner is subjected to frequent transfer; vide order dated 06.03.2025, he was transferred from the office of District Social Welfare, District – Dantewada to District Welfare Office, District – Mungeli. Pursuant thereto, petitioner has joined his services at District – Mungeli, however, within a period of 03 months, petitioner is again being transferred from District Welfare Office, District - Mungeli to the Office of Deputy Director, Social Welfare, Bhatapara, District - Balodabazar-Bhatapara on his own expense. However, the petitioner has not made any application for his transfer from District – Mungeli to any other place. He submits that according to his instructions, earlier, petitioner has sought transfer from District – Dantewada giving priority of 03 places, one of which is at Balodabazar-Bhatapara including Mungeli. 3. He contended that considering that application, petitioner was transferred from District – Dantewada to District - Mungeli and thereafter, the application has lost its efficacy as it has been acted upon by the respondents and therefore, the order of transfer for transferring the petitioner on his own expense subsequent to first transfer is bad in law. 4. On the other hand, learned counsel for the Respondents/State raises an objection and submits that petitioner is first challenging the order of transfer issued by the State Government, however, petitioner has not
3 submitted any representation before the Committee constituted as provided under the Transfer Policy, 2025.
He submits that if petitioner submits representation, it will be considered in accordance with law. 5. At this stage, learned counsel for the petitioner submits that pursuant to the letter dated 16.07.2025 written by the Deputy Director, petitioner is still working in the Office of Deputy Director, Social Welfare, Bhatapara, District – Balodabazar-Bhatapara. 6. I have heard learned counsel for the parties and perused the documents placed on record. 7. Perusal of the document i.e. order dated 06.03.2025 (Annexure P/2) would show that petitioner vide the said order was transferred from District – Dantewada to District – Mungeli. Subsequently, petitioner joined his services at Mungeli and it is submission of counsel for petitioner that the petitioner has been transferred on his own expense erroneously from Mungeli to District - Balodabazar-Bhatapara. It is stated that, petitioner has not submitted any application for his transfer from District – Mungeli and the petitioner has not submitted any representation before the Committee constituted under the Transfer Policy, 2025 and therefore, I find it appropriate to dispose of this writ petition permitting the petitioner to submit representation before the Committee constituted under the Transfer Policy, 2025 within a period of 10 days and in the event, petitioner submits representation, the concerned authority shall consider and pass order considering all the grounds to be raised in accordance with law expeditiously, within a further period of 04 weeks from the date of receipt of representation. It is ordered accordingly. 8. Further, considering the submission of counsel for the parties, it is
directed that till representation to be submitted by the petitioner is decided, effect and operation of the impugned order of transfer dated
4 25.06.2025 (Annexure P/1) so far as it relates to the petitioner shall remain stayed.
9. With the aforesaid observation and direction, this writ petition stands
