No.20508 of 2025 ORDER: This writ petition is filed to declare the action of the respondents in withholding the payments of pending amounts of Rs.16,95,482/- (rupees sixteen lakhs ninety five eighty two only) even after finalizing the bills payable to the petitioner in relation to the seven works as follows: (I) Construction of C.C. drain from Uppalapati Ammiraju (H) to Murari R & B road in Seetharamapuram Village of Rajanagaram Mandal vide agreement No. ./ 2023-2024, dated 12.12.2024. (II) Construction of C.C. drain from Adabala Venkatarao (H) to Murari R & B road in Seetharamapuram Village of Rajanagaram Mandal vide agreement No. ./ 2023-2024, dated 12.02.2024. (III) Construction of C.C. drain from Thethala Anjireddy (H) to Aribolu Brahmaji (H) (both side) in Radheyapalem G.P. of Rajanagaram Mandal, vide agreement No. /2023-2024, dated 22.01.2024. (IV) Construction of C.C. drain from Gubbala Nageswara Rao (H) to Guttula Ramana (H) (both sides) in Radheyapalem G.P. of Rajanagaram Mandal, vide agreement No. /2023-2024. (V) Construction of C.C. drain from Karri Bulreddy (H) to Veeravalli Venkateswara Rao (H) (both sides) in Radheyapalem G.P. of Rajanagaram Mandal, vide agreement No. /2023-2024, dated 08.03.2024. (VI) Construction of C.C. drain Koppireddy Govindhu (H), Koppireddy Satyam (H) (both sides) in Radheyapalem G.P. of Rajanagaram Mandal, vide agreement No. /2023-24, dated 22.01.2024. (VII) Construction of C.C. drain from Mummama Nookamma (H) to Kanupuru R & B road in Seetharamapuram Village, Rajanagaram Mandal, vide agreement No. / 2023-2024, dated 12.02.2024. 3 BSB,J W.P. No.20508 of 2025 02. It is the contention of the petitioner that even though the respondents admit that the petitioner is entitled to the aforesaid amount, no payment has been made. The petitioner further contends that such non-payment of money is clearly arbitrary and high-handed, requiring interference of this Court. 03. On the other hand, learned Assistant Government Pleader for Gram Panchayat and Rural Development, while admitting about the claim of the petitioner, placed on record a copy of written instructions received from the respondent No. 3, vide Lr. No.A1 / Court Cases / 2026, dated 22.09.2026, stating that the amount payable to the petitioner after due statutory deductions is Rs. 17,56,706.00/-; that budget had not been released by the government for creation of bills and submission of the same to the Pay and Accounts office for making payment; that the bills would be submitted as and when the government releases budget in NIDHI portal. 04. The learned counsel for the petitioner requested to pass appropriate order for the payment of the amount admitted in the written instructions. 05. In view of the submissions made on both sides, the writ petition is disposed of, directing the respondents to pay an amount of Rs.17,56,706.00/- (seventeen lakh fifty six thousand seven hundred six rupees only) to the petitioner, along with the interest, if any, at the rate entitled, within a period of two (02) months from the date of receipt of a copy of this order. It is open to the petitioner to agitate the claim for higher rate of interest, if any, payable by the respondents, before an appropriate forum. 4 BSB,J W.P.
