HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 15882 of 2026 Court No. - 32 HON'BLE DINESH PATHAK, J.
1. Heard learned counsel for the petitioner; Shri Om Prakash Mishra, learned counsel appearing on behalf of respondent no.1 and Shri Krishna Mohan Asthana, learned counsel appearing on behalf of respondents no.2 to 5.
2. Instant writ petition has been filed seeking expeditious disposal of appeal dated 01.02.2021, sent through e-mail, challenging the order dated 18.12.2020 passed by the disciplinary authority. The petitioner has preferred the aforesaid appeal; however, the same is still pending consideration before the Chairman, Punjab National Bank, New Delhi (respondent no.3).
3. Shri K. M. Asthana, learned counsel appearing on behalf of respondents no.2 to 5 has contended that the petitioner has merely submitted a representation and has not preferred any appeal against the order dated 18.12.2020 passed by the disciplinary authority.
4. Having considered the rival submissions advanced by learned counsel for the parties and upon perusal of record, it is evident that, aggrieved by the
order dated 18.12.2020 passed by the disciplinary authority, the petitioner submitted communication through e-mail dated 01.02.2021. In the said communication, the petitioner has unequivocally stated in the subject line:
"please find attached my appeal against punishment imposed on me in the matter of charge-sheet dated 15.02.2020".
5. In view of the above, there can be no doubt that the petitioner intended to prefer an appeal against the order passed by the disciplinary authority. Merely because the communication was captioned as a "representation" Versus Counsel for Petitioner(s) : Nitin Sharma, Vikash Chandra Tiwari Counsel for Respondent(s) : A.S.G.I., Krishna Mohan Asthana, Om Prakash Mishra Ram Nath Mishra @ Ramanath Mishra .....Petitioner(s) Union Of India And 4 Others .....Respondent(s)
would not, in my considered opinion, alter the nature or status of the appeal preferred by the petitioner.
6. In this conspectus, as above, no useful purpose would be served by keeping the instant writ petition pending. Accordingly, without expressing any opinion on the merits of the case, instant writ petition is disposed of finally with a direction to the competent authority (respondent no.3) to consider and decide the appeal preferred by the petitioner through e-mail dated 01.02.2021, in accordance with law, expeditiously, preferably within a period of four months from the date of production of a certified copy of this
order and the self attested copy of the instant writ petition, provided the said appeal has not already been decided.
7. With the aforesaid observations/direction, instant writ petition is disposed of finally. September 30, 2026 VR WRIA No. 15882 of 2026 2 (Dinesh Pathak,J.) Digitally signed by :- VIBHA RATAN High Court of Judicature at Allahabad
