IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA Execution Petition No. 1016 of 2026 Decided on : 15.06.2026 Kamlesh Kumar ...Petitioner Versus State of H.P. and others …Respondents. Coram Hon’ble Mr. Justice G.S. Sandhawalia, Chief Justice. Hon’ble Mr. Justice Bipin Chander Negi, Judge. Whether approved for reporting?1 For the petitioner : Ms. Sangeeta Vasudeva, Advocate. For the respondents : Mr. Gobind Korla, Additional Advocate General, for respondents No. 1 & 2. : Mr. Jai Ram Sharma, Advocate, for respondent No.3 to 5. G.S. Sandhawalia, Chief Justice (Oral) Counsel for the petitioner does not press the execution petition as, apparently, way back on 27th January, 2020 (Annexure E-4), the respondents had written to the original writ petitioner, Kamlesh Kumar, the predecessor-in-interest of the present petitioner, to give his consent affidavit regarding allotment of land in the second phase area of District Jaisalmer. In such circumstances, we are of the considered opinion that the representation, which was sought to be executed in pursuance of orders passed in Civil Writ Petition No. 2233 of 2016 decided on 31st October, 2016, has been acted upon. 1Whether the reporters of the local papers may be allowed to see the Judgment? Yes -2- 2. Counsel further submitted that the order suffers from some irregularity and, the claim of the petitioner for allotment of land in District Sriganganagar had to be considered. In such circumstances, we are of the considered opinion that if the petitioner has any grievance against the order dated 27th January, 2020, she can file appropriate proceedings challenging the same, but no relief can be granted in the execution petition. 3. Accordingly, the execution petition is dismissed as withdrawn with liberty as aforesaid. Pending miscellaneous applications, if any, also stand disposed of. (G.S. Sandhawalia) Chief Justice (Bipin Chander Negi) Judge 15th June, 2026 (Tarun Singh)
