Heard Mr. S Dey, learned counsel for the applicants. Also heard Mr. RK Dev Choudhury, learned DSGI assisted by Ms. B Sarma, learned CGC for the respondents.
2. This application has been filed seeking enlargement of time for a further period of 45 days to enable the applicants to continue their stay in Guwahati.
Learned counsel for the applicants submits that applicant No. 2 has been
Page No.# 3/4 advised by the Gauhati Medical College and Hospital (GMCH) to take complete rest for a period of 45 days on account of general weakness and other medical issues prior to any decision to be taken to proceed for medical intervention which is surgery. The accompanying writ petition being WP(C) No.1783/2026 in which the Interlocutory Application has been filed stood disposed of by direction dated 01.06.2026, whereby the respondents were directed to accommodate the petitioner No.1 for further period of 2 (two) months within which the petitioner no.2 was required to undergo surgery as per medical advice. Pursuant thereto, the petitioner/applicant no.2 was examined by the composite hospital and thereafter, she was put up for opinion in the GMCH. The opinion of the GMCH is available at page-34 and 35 of the application. The opinion clearly reveals that the applicant no.2 needs to rest for 45 days.
3. On the earlier occasions, the respondents were permitted to obtain instructions as to whether the couple posting is permissible for the applicants as vide the transfer orders dated 22.12.2025 and 14.01.2026 the applicant no.1 was transferred to Jalandhar and the applicant no.2 was posted at Lucknow respectively.
4. Learned DSGI submits that, under the applicable policy, the benefit of couple posting is permissible only at every alternate transfer/posting. He
Page No.# 4/4 submits that the petitioner and her husband are presently availing the benefit of couple posting and are both posted at Guwahati. Therefore, they would be entitled to claim the benefit of couple posting only at the next alternate transfer/posting, as and when such transfer is effected.
5. Considering the submissions made by the learned DSGI and upon perusal of the materials before the Court and pursuant to the medical opinion given by the GMCH, this Court considers it appropriate to allow the Interlocutory Application by extending a further period of 60 (sixty) days to the applicant no.2 for undergoing surgical procedure within the said period of time.
6. In terms of the above, the Interlocutory Application stands allowed and
disposed of. JUDGE Comparing Assistant
