2 Dr.YLR,J Crl.A.No.584 of 2026 Dated 24.09.2026
The Court made the following:
ORDER:
The Criminal Appeal has been filed under Section 14A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 19891, seeking to enlarge the appellant Nos. 1 and 2/accused Nos.2 and 3 on bail by setting aside the order dated 20.07.2026 passed, in Crl.M.P.No.788 of 2026 by the learned Principal District and Sessions Judge, East Godavari at Rajamahendravaram in Crime No. 155 of 202 on the file of Sarpavaram Police Station, Kakinada District, registered for the alleged offences punishable under Sections 61(2)(a), 232(1), 351(2), 127(2) read with 3(5) of the Bharatiya Nyaya Sanhitha, 2023 (for brevity ‘the BNS’).
2. Sri C.Raghu, learned Senior Counsel appearing on behalf of Sri Sripathi Ravi Teja, the learned counsel for the Appellants, submits that appellants are innocent of the alleged offences and have been falsely implicated in the case and that the learned Trial Court has erred in dismissing the Crl.M.P.No.788 of
2026. They are law-abiding citizens. They have been in the judicial custody since 10.05.2026 and that they undertake to strictly adhere to any conditions that may be imposed by this Court. In light of the foregoing submissions, the
learned counsel prays that the present appeal be allowed in the interest of justice. 3. Per contra, Mr.A.Sai Rohit, the learned Assistant Public Prosecutor and the Legal Aid Counsel for respondent No.2, vehemently opposed the grant of bail to the appellants, submitting that the investigation is still underway and

several material witnesses remain to be examined. It is contended that the learned Trial Court has rightly dismissed the Crl.M.P.No.788 of 2026, and if the appellants are released on bail at this stage, there is a strong likelihood that he may abscond, thereby hampering the ongoing investigation and evading the process of law. In view of the foregoing submissions, it is urged that the appeal be dismissed. 4. Heard the learned counsel for the appellants, the learned Legal Aid Counsel for respondent No.2, and the learned Assistant Public Prosecutor. Perused the record. 5. As seen from the record, the appellants are arrayed as Accused Nos.2 and 3. Charge-sheet has already been filed. Appellants were arrested on 10.05.2026 and have been in judicial custody from the past 138 days. All the alleged offences in the said crime are punishable with an imprisonment below 7 years. The allegation against the appellants is that they have threatened and influenced the witnesses, the appellants herein undertook to strictly adhere to any conditions that may be imposed by this Court and cooperate with the learned Trial Court until the disposal of the matter. 6. Having regard to the stage of the Trial in the said crime, and considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the appellants, and the period of incarceration suffered by the appellants, this Court is inclined to enlarge the appellants/accused Nos.2 and 3 on bail with some stringent conditions. 4 Dr.YLR,J Crl.A.No.584 of 2026 Dated 24.09.2026
7. In the result, the Criminal Appeal is allowed with the following stringent conditions: i. The appellants/accused Nos.2 and 3 shall be enlarged on bail subject to executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties each for the like sum, each to the satisfaction of the Principal District and Sessions Judge, East Godavari at Rajamahendravaram. ii.
The appellants/accused Nos.2 and 3 and their sureties shall furnish their permanent residential address details and identity particulars to the concerned police and keep the police informed about the change in address, if any, time to time. iii. The appellants/accused Nos.2 and 3 shall appear before the learned Trial Court for every adjournment without fail. iv. The appellants/accused Nos.2 and 3 shall not involve in the similar offences while they are on bail. v. The appellants/accused Nos.2 and 3 shall not, directly or indirectly, make any inducement or threat the de-facto complainant/respondent No.2. 5 Dr.YLR,J Crl.A.No.584 of 2026 Dated 24.09.2026
vi. The appellants/accused Nos.2 and 3 shall surrender their passport, if any, to the investigating officer.
