GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to issue a Writ , Order or a direction, more particularly one in the nature of Writ of Mandamus, by directing the Respondent No.2 for disposal of the petitioners application of complaint lodged, the same pending disposal before Respondent No.2 as in ROC.Cl/607/2024 Dt.02.05.2025, ROC.C 1/607/2024 Dt.05.05.2025, ROC.C 1/735/2024 Dt.20.05.2025, further ROC.Cl/735/2025 Dt.23.05.2025 filed under the Maintenance and Welfare of Parents and Senior Citizens Act., 2007 , consequentially direct the Respondent No.7 not to interfere in any manner against these petitioners relating to the petitioners owned and possessed subject schedule property viz. New Power House in Sy.No. 100/4, within these, site admeasuring East to West on Northern side 35 ft. or 10.65 mts. East to West on Southern side 28 ft. or 8.53 mts. North to South on Eastern side 44 ft. 13.41 mts and North to South on Western side 47 ft. or 14.33 mts comprising a 3 total extent of 159.25 sq. yards of vacant site only. In both items 1 and 2 constructed RCC building along with all fixtures and appurtenant site therein in which the present existing house of G plus 1 was constructed, presently with Property Tax Assessment No. 1009020702, with Water Tax , and to pass…” 2. Heard learned counsel for the Petitioners and the learned Assistant Government Pleader. 3. Mr. Jitendra Kanyalur, learned counsel for the Petitioners, submits that a petition under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 20071 (for brevity ‘the Act’) was filed on 30.04.2025, but the petition was not disposed of by the learned Presiding Officer, Tribunal Maintenance and Welfare of Parents and Senior Citizens-cum-Sub Collector, Madanapalli. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that appropriate orders in accordance with the law would be passed by the Tribunal within the reasonable time. As per section 5(4) read with 23 of ‘the Act’ enquiry shall be completed and appropriate orders have to be passed within the maximum period of 120 days. 5. It has to be pointed out that the learned Presiding Officer of the Tribunal in her latest instructions at one para submits that no formal written orders were passed, but in the very same para, it is stated that based on mutual understanding the matter was treated as settled at that stage. At the subsequent para, it was mentioned that they mutually agreed and a resolution was arrived between the parties. 1 The Act, 2007 4 6. Be that as it may as per legislative mandate of ‘the Act’, the petition filed before the learned Tribunal shall be disposed of within maximum period of 120 days. 7. Considering the facts and circumstances of the case, recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, directing the Tribunal to dispose of the O.P. in ROC No.C1/607/2024 dated 02.05.2025 as early as possible and submit the report to the District Collector, Madanapalle who in turn shall submit the report to the Registrar (Judicial) for the purpose of record. 8. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ________________________ Dr.Y.
