JUSTICE ANJAN MONI KALITA ORDER 20.08.2026 1. Heard Mr. T. Laskar, learned counsel appearing for the accused applicant. Also heard Mr. R. J. Baruah, learned Addl. P.P., Assam appearing for the State respondent. 2. This is an application under Section 482 BNSS, 2023 for granting pre- arrest bail to the accused applicant, namely, Abid Ahmed Chowdhury in connection with Lanka P.S. Case No. 03/2026 registered under Sections 61(2)/126 (2)/310 (2)/351(3) of BNS, 2023. 3. The case arose out of the FIR dated 04.01.2026, lodged by one Mahmodul Hassan with the allegations that on 02.01.2026, he and his friends were returning home in a four wheeler bearing No. AS-01-FA-7844 and subsequently, near Nilbagan, the accused signaled their vehicle to stop, alleging that an accident had taken place and as they did not stop, the accused chased them in another four wheeler bearing registration No. AS-01-DH-6966 along with a motorcycle and thereafter, blocked their way and assaulted them. Later on, they ran away upon seeing a police vehicle. 4. A coordinate Bench of this Court by order dated 05.02.2026 has granted interim pre-arrest bail to the accused applicant. The learned counsel for the accused applicant submits that in terms of the aforesaid order dated 05.02.2026, the accused applicant has cooperated with the investigation by appearing before the I.O. and he has given his statements. 5. The case diary in this instant case has been received and the same is Page No.# 3/3 perused. 6. On perusal of the case diary as well as on consideration of the submissions made by the learned counsel appearing for the parties, this Court is of the considered opinion that the interim pre-arrest bail order dated 05.02.2026, should be made absolute. 7. Accordingly, the instant application stands disposed of by making interim pre-arrest bail order dated 05.02.2026 absolute. 8. Send back the case diary. JUDGE Comparing Assistant
