1 IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA COPC No.44 of 2026 Decided on: 15.06.2026 ------------------------------------------------------------------------- Surinder Kumar
…..Petitioner Versus K.K.Pant and others
.....Respondents ------------------------------------------------------------------------- Coram Ms. Justice Jyotsna Rewal Dua Whether approved for reporting?1 For the Petitioner: Mr. Dushyant Dadwal, Advocate. For the Respondents: Mr. Y.P.S. Dhaulta, Additional Advocate General. ------------------------------------------------------------------------- Jyotsna Rewal Dua, Judge Following order was passed in this matter on 01.06.2026:-
“Annexure R-V appended alongwith office instructions dated 25.05.2026 quantifies the payable arrears at Rs.1,97,200/- w.e.f. 01.04.2025 to
01.05.2026. Learned proxy counsel appearing for the petitioner contends that firstly, the aforesaid amount has not yet been paid to the petitioner and secondly, the period for which the arrears have been due to the petitioner, has been incorrectly mentioned in the office instructions. That petitioner’s initial appointment on daily wage basis was on 06.02.2023 and not 01.04.2025. That petitioner’s services, in fact, were regularized on 01.04.2025. Learned proxy counsel appearing for the petitioner drawing attention to paragraph 5 of the judgment dated 05.12.2024 in CWP No.8168 of 2023 (Surinder Kumar Versus State of Himachal Pradesh & Ors.) highlights that consequential benefits are to be released to the petitioner with effect from the date of his initial appointment on daily wage basis. 1Whether reporters of print and electronic media may be allowed to see the order? Yes. 2 Final opportunity of two weeks is granted to the respondents to come up with clear and specific instructions on all the aforesaid issues, failing which the respondents shall remain present in the Court on the next date of hearing. List on 15.06.2026.” Pursuant to above, learned Additional Advocate General has placed on record instructions dated 11.06.2026 from Deputy Commissioner, Kangra at Dharamshala clarifying that monetary benefits payable to the petitioner have been computed for his entire daily wages service period i.e. w.e.f. 06.02.2023 to 31.03.2025. However, in terms of office instructions, an amount of ₹1,97,200/- quantified as arrears payable to the petitioner has not been released to him till date for want of allocating the requisite budget under ‘Charged Expenditure’. 2. Let arrears due and admissible to the petitioner be now released in his favour within three weeks i.e. by or before 08.07.2026. 3. In view of above, present contempt proceedings are closed. Notices issued to respondents are discharged. Respondents to release the payable arrears to the petitioner by 08.07.2026.
Pending miscellaneous application(s), if any, shall also stand disposed of. Jyotsna Rewal Dua June 15, 2026
