The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the order dated 4.5.2026, passed in Criminal Case No. 2330 of 2020, arising out of Case Crime No. 517 of 2017, under Sections 147, 323, 427, 452, 504, 506, 380, 354(Kha), 325 of IPC, Police Station- Nawabganj, District- Prayagraj, whereby an application to commit the case and to be tried as cross case i.e. S.T. No.566 of 2019, which was arising out of Case Crime No.519 of 2017, under Sections 323, 504, 506, 452, 354(A), 307 IPC, has been dismissed, which is pending in the Court of Additional Sessions Judge, Court No.2, Prayagraj. Learned counsel for the applicant fairly admits that the application has been filed before the Magistrate where Criminal Case No.20330 of 2020 is pending for trial and wants liberty to file appropriate application before Additional Sessions Judge, Court No.2, Prayagraj to conclude the trial of both the cases, together. Accordingly, present application is disposed of with a direction to the court concerned to decide the application of the present applicant in Versus Counsel for Applicant(s) : Ajay Kumar Tiwari, Sangam Lal Kesharwani Counsel for Opposite Party(s) : G.A.
